Introduction Welcome to CORGI Trade. These Terms & Conditions govern the relationship between us, CORGI Services Limited, a company incorporated in England and Wales with company number 03268198, and registered office at Suite 2 Healey House, Dene Road, Andover, Hampshire, SP10 2AA (“we”, “us”, or “our”), and customers (“you” or “Customer”) that wish to use the CORGI Trade Platform (“CORGI Trade”) to place a request for the installation, repair, or servicing of equipment that falls within the scope of CORGI Trade (“Enquiry”).
These Terms & Conditions You should read these Terms & Conditions carefully and ensure that you understand them before submitting any Enquiry. We suggest that you keep a copy of these Terms & Conditions for future reference. These Terms & Conditions may change from time to time so please review them each time you use the platform
The CORGI Trade Platform We operate a platform through which we connect Customers seeking services with our members, who are approved engineers (“Engineers”). We do not provide services ourselves, we do not employ Engineers, and we act only as an intermediary connecting Customers with Engineers. Our responsibility is strictly limited to operating the platform and we are not responsible for the quality, safety, or legality of services provided by any Engineer. CORGI Trade is intended for use in the United Kingdom only. By placing an Enquiry you confirm that you have read and accept these Terms & Conditions.
Creating an Enquiry You will need to create a profile with CORGI Trade in order to submit an Enquiry, to make payment, to communicate with the Engineer allocated to your Enquiry, and to leave a review. The information you provide to create your profile will be used to verify your identity and will be shared with the Engineer allocated to your Enquiry. We will handle any personal information that you provide in line with our Privacy Policy.
Using CORGI Trade By using CORGI Trade, you warrant that:
- you are at least 18 years old and are legally able to enter into a contract;
- you are resident in the United Kingdom and the requested services are to be performed in the United Kingdom;
- you own or live at the property to which the Enquiry relates (“the Property”);
- you have adequate utilities supply to the Property;
- you have all necessary permissions that may be required for the performance of the works at the Property (including any additional permissions that may be required as detailed in paragraph 7);
- the services requested in your Enquiry will be for personal and domestic purposes, not for business purposes;
- you will provide accurate and complete information when placing an Enquiry;
- you will use the platform only for lawful purposes and be polite, reasonable and considerate in your communications with us and the Engineers;
- you will act in good faith to inspect and accept the services provided by an Engineer;
- you will act in good faith to resolve any complaint or dispute that might arise with an Engineer;
- you agree to use the platform in accordance with these Terms & Conditions, our policies and other applicable rules in place from time to time.
Submitting an Enquiry When you submit an Enquiry you should provide complete and accurate details related to the services being requested, including photographs and the make/model numbers of equipment where applicable. An Enquiry should not be submitted where emergency work is required to be undertaken and we accept no responsibility for any delay that might occur in the performance of the requested works. We may match you with an Engineer to provide a quote or proposal for the requested works. Upon your acceptance of the quote or proposal, a contract is formed between you and the Engineer on the Engineer’s terms of business. You should request a copy of those terms prior to accepting the Engineer’s quote or proposal.
Additional Permission You acknowledge and accept that you may need to seek additional permissions before work can be carried out by an Engineer, or before your Enquiry will be admitted to CORGI Trade, if:
- you do not own the Property (for example, have a lease with a landlord or you live in social housing), in which case you may need your landlord’s or local authority’s permission to carry out the requested works;
- you need to get a party wall agreement with any neighbouring properties;
- the Property is a listed building, in which case you may need to get permission from your local planning authority to carry out the requested works.
Unless you inform us otherwise in your Enquiry, we will assume that you have all required permissions, and we shall not be responsible if work is carried out without the relevant permissions being in place. You are solely responsible for ensuring that you have all required permissions and shall indemnify us and the Engineer for any losses suffered as a result of any failure on your part in that respect.
Allocation of Engineer We will look to allocate an Engineer appropriate to your Enquiry on the basis of their skillset, locality and availability. Your Enquiry is subject to acceptance by the Engineer, who may decline to accept your Enquiry at their discretion. The allocated Engineer may issue a quote or proposal for the work requested in the Enquiry or seek further information from you to enable them to do so. You are responsible for ensuring that the allocated Engineer is appropriate for the work requested in the Enquiry and that the quote or proposal provided by them is suitable for your needs. Where you accept the quote or proposal provided by the Engineer you should agree a clear scope of work, timeframe and cost, and all communication should be conducted through CORGI Trade.
Price We do not endorse, approve or underwrite any price information provided by an Engineer. A quote is valid for 30 days from the date of the quote, unless stated otherwise and unless the scope of work changes, or there is a delay in the provision of the requested services due to your actions or omissions. The price set out in the Engineer’s quote includes VAT at the current rate and, where applicable, the cost of removing all non-dangerous materials, including old equipment and replaced parts. The price stated in the quote does not include additional work outside of the agreed scope of work or required work that was not reasonably evident from the information provided in the Enquiry or reasonably foreseeable until performance of the work was underway.
Accepting a Proposal You may accept or decline any quote or proposal received from an Engineer at your discretion. Your acceptance of an Engineer’s quote or proposal forms a contract between you and the Engineer, and we are not a party to that contract and accept no liability for the works performed under that contract. Engineers are entitled to update and revise any quote or proposal given if additional information is submitted after the Enquiry has been considered, if you request the works be conducted at a later date, or if you reject, or fail to accept within 30 days, the quote provided by an Engineer. You may cancel your Enquiry within 14 days of accepting a quote provided the work has not been commenced. Cancellation fees may be applicable in circumstances of late cancellation, where work has already commenced, or if out-of-pocket expenses have been incurred in anticipation of the requested works, subject to the Engineer’s terms of business. You should therefore check the Engineer’s terms of business before terminating your contract.
Payment An invoice for the work undertaken by an Engineer in response to your Enquiry, including any additional work performed, shall be issued to you by the Engineer through the CORGI Trade payment processing portal. You are responsible for making payment in full and cleared funds by the due date stated on the invoice and all payments shall be made through the CORGI Trade payment processing portal. Ownership of any appliances and parts provided by the Engineer in the course of their provision of the services shall pass to you upon payment of the relevant invoice for the works. No fees are payable by you for your use of CORGI Trade, but we take a percentage of the Engineer’s total invoice as our fee for the provision of our services in operating CORGI Trade for our members.
Performance of the Requested Works You agree to provide the Engineer with safe access to the Property to allow them to carry out the requested works, at the date and time agreed between you. Either you, or somebody else who can give instructions on your behalf (and is 18 years or over) must be present at the time of performance of the works. You acknowledge that some works (including installation of equipment) may cause some incidental damage which will be your responsibility. We accept no responsibility for performance of the requested works by the Engineer and any dispute or complaint about the work should be raised to the Engineer, with us in copy, through the CORGI Trade platform.
Warranty As a member of CORGI Trade, Engineers are vetted to ensure that they hold the requisite qualifications, licences and insurance to provide the services that may be allocated to them. Engineers warrant that the services provided to Customers shall be conducted in accordance with good industry practice and will comply with all applicable laws and regulations. The Engineer’s work will be guaranteed for a period of 30 days following completion of the work where such work is a service or repair, and 12 months where such work is an installation of new appliances, subject to no third-party interference with the initial work.
Return Visits If, within the guarantee periods detailed at paragraph 13, you prove to our reasonable satisfaction that the works carried out by the Engineer are defective, a fault arises, or further repair is required, the Engineer shall return to you to undertake rectification work at no cost, provided that the defect does not arise due to Customer or third-party interference with the initial work. You should notify us and the Engineer of any fault or default in the works as soon as possible after it is discovered and at all times within the guarantee periods detailed at paragraph 13. Remedial or additional work requests should be raised and managed to completion through CORGI Trade.
Equipment Guarantee Engineers will register appliances and parts for all applicable manufacturers guarantees/warranties, obtain any certificates required for the installation or repair of appliances, and will provide such certificates and relevant documentation to the Customer. It is your responsibility to read the manufacturer’s guarantee carefully. The manufacturer warranty will be subject to the terms and conditions set out by the manufacturer. You are responsible for maintaining full and accurate service records for all equipment and without such records, the CORGI Trade guarantee (and the manufacturer guarantee) may be void.
Insurance As a member of CORGI Trade, Engineers are required to hold a minimum of £2 million in Public Liability Insurance for the duration of their membership and for at least 12 months after termination of their membership with CORGI Trade. You may request proof of cover at any time prior to entering a contract with an Engineer and during the course of your agreement.
Liability Nothing in this contract affects any of your statutory rights that can’t be excluded by law. We act as an intermediary only, connecting Customers with Engineers, and are not a party to the contract for services that is formed between Customers and Engineers. We are not responsible for the acts or omissions of Engineers and accept no liability for any losses, damages, costs or expenses suffered or incurred by either party arising from or connected to the contract for services that is formed between the Customer and Engineer. You agree to indemnify us for any losses, damages, costs or expenses suffered by us arising from your breach of these Terms & Conditions, negligence, or fraudulent misrepresentation. These Terms & Conditions will not affect our liability to you for death or personal injury as a result of our negligence, fraud or fraudulent misrepresentation. Notwithstanding the provisions of this paragraph 17, our total liability to you for any claim or series of related claims is limited to £100.
Security You are responsible for maintaining the security of your CORGI Trade profile. All communications with the Engineer allocated to your Enquiry should be made through CORGI Trade so that they can be verified and monitored for compliance with our Engineer Terms & Conditions.
Platform Content We accept no responsibility for content uploaded or shared in CORGI Trade by Engineers, Customers or any third party, including links to any third-party websites. You warrant that all content that you upload or share in CORGI Trade will be accurate, true, appropriate, respectful and lawful. We reserve the right to remove any harmful, unlawful, inappropriate or inaccurate content posted by any party to CORGI Trade. If you wish to report any inappropriate content or seek to have your content removed from CORGI Trade, then please do contact us at hello@staging-node-k48gq7-csl-trade-dev-com.stackstaging.com. We reserve the right to maintain a copy of any uploaded content for internal record-keeping purposes to enable us to comply with our legal duties of disclosure, should that be necessary.
Platform Availability We do not guarantee that CORGI Trade or any content or functionality contained within the platform will always be available or be uninterrupted. CORGI Trade may be unavailable at times when we need to update our servers, implement fixes or amend functionality. Customers use CORGI Trade at their own risk and we make no representations and provide no warranty as to quality, fitness for purpose, non-infringement, security or accuracy of CORGI Trade and its content. CORGI Trade is not provided to you as a personal service and we make no warranty that it will meet your requirements. We shall have no liability to you for any losses, damages, costs or expenses that you may incur as a result of your inability to use or access CORGI Trade or any reliance that you place on the content contained on the platform.
Cancelling Your Enquiry You can stop using CORGI Trade and withdraw your Enquiry at any time, provided there is no outstanding debt owed against your account. It is your responsibility to download a copy of all communications recorded in the platform prior to deleting your Enquiry. We may cancel or suspend your Enquiry at any time at our discretion, including if we become aware that you have breached these Terms & Conditions, have acted unfairly, unlawfully, or been abusive to any Engineer, or post or upload inaccurate, misleading or unlawful content to the CORGI Trade platform. We may disclose data and personal information that you submit to CORGI Trade to the courts and law enforcement authorities as we consider necessary or to comply with our legal obligations to do so.
Complaints If you wish to raise a complaint about CORGI Trade or the service that you have received from an Engineer then you should contact us in writing, setting out comprehensive details of your complaint, including applicable dates. You can contact us by: a) email at hello@staging-node-k48gq7-csl-trade-dev-com.stackstaging.com, or (b) post at CORGI Trade Suite 2 Healey House, Dene Road, Andover, Hampshire, SP10 2AA. We will aim to respond to your complaint within 10 working days of receipt.
Data Protection You acknowledge that to enable us to operate CORGI Trade and for our Engineer to respond to your Enquiry it is necessary for us to share your personal information (including name, address, contact telephone number, email address and details of your Enquiry) with our Engineers. Information that you provide to us may be used to facilitate a response to your Enquiry, to operate payment of the services provided by an Engineer, to improve our service and to undertake statistical analysis and testing. We will process your data in accordance with our Privacy Policy.
GENERAL LEGAL TERMS
Severance If any of these Terms & Conditions should be deemed invalid, illegal, or unenforceable for any reason by any court of competent jurisdiction then such term shall be deleted and the remaining terms shall survive and remain in full force and effect and continue to be binding and enforceable.
Notices Any formal notice required to be given under these Terms & Conditions must be in writing and must be sent to the other party to their registered address by registered mail, or to the nominated email address confirmed as accepting service of notices. Any notice sent by post shall be deemed to be received on confirmed delivery and for notices sent by email, shall be deemed delivered as stated by the email server.
Entire Agreement Your use of CORGI Trade, comprising these Terms & Conditions and all policies referred to in them, constitutes the entire agreement between you and us in relation to CORGI Trade. You acknowledge that in entering into this agreement you did not rely on any statement, representation, assurance or warranty (whether made innocently or negligently) that is not set out in this agreement. You agree that you shall not have any claim for innocent or negligent misrepresentation or negligent misstatement based on any statement in this agreement.
Intellectual Property We retain ownership of all intellectual property rights that arise in the CORGI Trade platform. You are granted a non-exclusive, non-transferable, revocable licence to use CORGI Trade in accordance with these Terms & Conditions. You grant us and our members a royalty-free, irrevocable licence to use, copy, adapt, amend, distribute and display (whether on the platform or other media outlet), all content that you add or upload to CORGI Trade. You warrant that you are the owner of the content that you add or upload to CORGI Trade and you waive your moral rights in the same.
Third Party Rights A person who is not a party to these Terms & Conditions has no right under the Contracts (Rights of Third Parties) Act 1999 to enforce any term of these Terms & Conditions.
Waiver Any delay by either party in enforcing any of these Terms & Conditions shall not be deemed a waiver or prejudice the rights of either party to enforce the same.
Severability If any provision of these Terms & Conditions is found to be unenforceable or invalid, the remaining provisions shall continue to be valid and enforceable.
Governing Law These Terms & Conditions and any dispute or claim arising out of them or your engagement of an Engineer are governed by and shall be construed in accordance with the laws of England and Wales. Wherever you live you can bring claims against us in the courts of England and Wales. If you live in Scotland or Northern Ireland, a claim may instead be brought in the courts of the country that you live in. We will bring any claim against you in the country that you live in.
